1. Agreement to Terms

By accessing themoroccoway.com or submitting a booking or inquiry, you agree to be bound by these Terms and Conditions in full. If you do not agree, please do not use our website or services.

2. About The Morocco Way

The Morocco Way is a tourism services company registered in the Kingdom of Morocco, offering activities, excursions, transfers, rentals, and wellness experiences in Agadir and across Morocco. We operate through themoroccoway.com.

3. Our Services

We provide the booking and organisation of tourism experiences including guided excursions, outdoor activities, water sports, private transfers, vehicle rentals, and wellness packages. All services are subject to availability and to the specific conditions communicated at the time of booking.

We act as an organiser and, in some cases, as an intermediary between you and third-party operators. Where we act as intermediary, the operator's own terms may also apply.

4. Bookings and Confirmations

A booking is confirmed only when we send you written confirmation by email or WhatsApp, including the activity details, date, and total price. Verbal or tentative confirmations do not constitute a binding agreement.

We reserve the right to decline any booking without providing a reason, in which case any payment already received will be refunded in full.

5. Pricing and Payment

All prices displayed on our website are in Euros (EUR) unless stated otherwise. Prices are per person unless explicitly described as a group or private rate.

Accepted payment methods may include cash on arrival, PayPal, Stripe, and CMI Maroc, subject to the methods active at the time of your booking. Prices are subject to change without prior notice until a booking is confirmed in writing.

6. Cancellations and Refunds

Please refer to our Cancellation Policy page for full details on cancellations, refunds, no-shows, and date changes. By confirming a booking, you agree to the cancellation terms applicable at that time.

7. Your Responsibilities

By making a booking, you confirm that you and all members of your group are physically fit and capable of participating in the chosen activity. You agree to comply with the safety instructions and guidelines provided by our guides and operators at all times.

You acknowledge that some activities carry inherent risks and that you participate at your own risk. You are responsible for ensuring that you hold appropriate travel and activity insurance covering the services booked.

You are responsible for arriving at the agreed meeting point on time with all required documents and equipment as communicated at confirmation.

8. Limitation of Liability

The Morocco Way shall not be liable for any personal injury, loss, theft, or damage to property occurring during any activity or transfer, unless caused directly by our proven negligence.

We are not responsible for delays, disruptions, or cancellations caused by weather conditions, road conditions, mechanical failure, strikes, civil unrest, or any other circumstances beyond our reasonable control.

Our total liability in connection with any booking shall in no case exceed the amount paid by you for the specific service in question.

9. Intellectual Property

All content on themoroccoway.com — including text, photographs, graphics, logos, and design — is owned by or licensed to The Morocco Way. You may not reproduce, copy, distribute, or use any content from this website without our prior written consent.

10. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. The current version will always be available at themoroccoway.com/terms. Your continued use of our services after any update constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Morocco. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Agadir, Morocco.
